- Primero. Dejar sin efecto el auto del cinco (5) de enero de 2005, proferido por el Juzgado 20 Penal Municipal de Bogota D.C., dentro de la accion de tutela promovida por el senor Luis Orlando Bernal Barbosa.
- Segundo. Ordenar al Juzgado 20 Penal Municipal de Bogota D.C., que inicie, de forma inmediata, el tramite de la accion de tutela de la referencia conforme a las previsiones del articulo 86 de la Constitucion Politica y del Decreto 2591 de 1991.
